GENERAL

These Terms and Conditions governs your use of, and purchases from, the domains www.lottaludwigson.com and their subdomains (referred to as “the Website”) and will be valid for all your future transactions with LOTTA LUDWIGSON GmbH (referred to as “us” or “LOTTA LUDWIGSON” and visits to the site. We encourage our buyers (referred to as “you” or “the customer”) to read these terms and conditions in their entirety before using our website. 

By clicking the button “Pay now” you agree to be bound by these Terms and Conditions. Please make sure that you have read and understood these Terms and Conditions when using our site. LOTTA LUDWIGSON reserves the right to revise these Terms and Conditions and users are responsible for keeping themselves updated with such changes. You can download our Terms and Conditions here.


FORMATION OF CONTRACT 

Once we have received your order, you will receive an automatic e-mail confirming your order. Please note that the confirmation e-mail is only an acknowledgement that we have received your order and not a binding acceptance of your order. A binding contract is formed when we send you a shipping confirmation e-mail.

The presentation of the products does not constitute a binding contract offer. To place an order, you must follow the online shopping process of adding the desired goods to your virtual shopping cart and following the shopping process on the cart and checkout pages. You have the chance to review your order and then click “check out” to be directed to your chosen shipping and payment method.

By completing this step, the customer submits a legally binding offer of contract with regard to the goods contained in the shopping cart. Please note, that all orders submitted by you are subject to acceptance by us. We may choose not to accept your order and reserve the right not to deliver for any reason without any liability to you. Examples of when we may not accept your order include, but are not limited to, incorrect stock level shown on site at the time of receiving the order, incorrect price displayed on the website or if we are unable to authorize your payment.


When your offer to buy from us is received, you will get an automatic email confirming your order (“order confirmation e-mail”) to the e-mail address you submitted. Please note that the confirmation e-mail is only an acknowledgement that we have received your order and not a binding acceptance of your order. A binding purchase agreement is entered into as soon as your order has been accepted by LOTTA LUDWIGSON and a shipping confirmation e-mail has been sent to the email address you submitted.


The order can only be submitted if the customer has accepted these terms and conditions by ticking the box "I AGREE TO THE TERMS AND CONDITIONS."


RESALE POLICY

You may purchase products on the Website for personal use only and not for resale. By placing an order on the Website, you certify that you are purchasing the product for your own personal use and not for resale and that you accept our Terms and Conditions. We reserve the right to refuse orders for any reason without explanation.


PRICES & INVENTORY

LOTTA LUDWIGSON does not guarantee that all items included on the Website are in stock at the time of your order. In the event that an item is unavailable, you will be contacted shortly by phone or e-mail. LOTTA LUDWIGSON cannot guarantee that the content on the page is free of inaccuracies or typographical errors at all times. Neither can we guarantee that all information is up-to-date and LOTTA LUDWIGSON may at any time amend the content of the website. We reserve the right to correct any errors or inaccuracies, to update information or cancel orders if any information on the Website is inaccurate at any time without prior notice (including after you have submitted your order).

If an item happens to run out of stock before the status has been correctly updated on the Website, LOTTA LUDWIGSON will notify the customer via e-mail. We may then suggest an alternative item, or cancel the order in question and fully refund your purchase. If incorrect price information has been shown on the Website you will be given the opportunity to either purchase the item at the correct price, or cancel the order. LOTTA LUDWIGSON reserves the right to cancel a purchase agreement if fraud is suspected.

The prices on our Website constitute the total price (including sales tax and delivery costs within the EU). In the case of deliveries to countries outside the European Union, delivery costs are indicated separately during the checkout process on the Website. 

Please note that in some countries outside of EU additional duties may be payable to your local authorities on receipt of your delivery. You will be responsible for payment of any such import duties and taxes. LOTTA LUDWIGSON has no control over these charges and cannot predict their amount. For further information we suggest you contact your local customs office before placing your order. Taxes and duties incurred on refused packages are not covered by LOTTA LUDWIGSON.

DISCOUNTS & GIFT CARDS

We reserve the right to change prices and discount items from time to time without prior notice. Gift Card codes or discount codes are only valid once per person (unless otherwise stated) and only within the stated period of time. They may not be combined or transferred to another purchase. Gift Cards cannot be bought with discount codes.

From time to time, we may offer bundles of products at a discount. If you purchase two items that are part of a bundle deal, you may receive a bundle discount on one or more of those items. If you return only the non-discounted bundle item, the discount on the discounted bundle item you decide to keep becomes invalid. In this case, you will be refunded only the amount up to the regular cost of the item you keep.  


 PAYMENT

Payment is currently only possible in the currency set out on our Website, which is Euro (€). Payment can be carried out by credit or debit cards, Klarna (Sofort), Ideal or PayPal. Available payment methods vary depending on your location and shipping destination.

When paying by credit card you will be asked for the card number, the name of the cardholder, its period of validity and the CVC code. Other payment methods may require a birth date, personal ID numbers or bank account number. We do not store any credit card information or such sensitive information solely necessary for payment. You confirm that the credit/debit card, bank information or other personal information that is being used is yours or that you have been specifically authorized by the owner of such credit card, bank or personal information.

Payment is due immediately after conclusion of the contract, unless the parties have arranged a later date. If payment is pending, LOTTA LUDWIGSON reserves the right to halt the shipment until the full amount has been received. A purchase may be declined if payment did not go through or fraud is detected. 


RESALE POLICY

You may purchase products on the Website for personal use only and not for resale. By placing an order on the Website you certify that you are purchasing the product for your own personal use and not for resale and that you accept our Terms and Conditions. We reserve the right to refuse orders for any reason without explanation.


DISCLAIMER REGARDING PRODUCT INFORMATION

LOTTA LUDWIGSON has the right to adjust product information, such as product pictures, product information and offers without notice. The product images and information texts available reflect the product as much as possible but we reserve the right for any errors that may appear on the page and cannot guarantee that all pictures accurately reflect the true appearance of the products. We cannot guarantee that colors on the website will be true to life or the materials appearance and touch being reflected correctly.


DELIVERY

LOTTA LUDWIGSON accepts and processes purchases in the same order in which they are submitted to the Website. 

The delivery of goods is subject to availability. Goods will be dispatched on regular working days, Monday to Friday. We aim to dispatch all orders within 1-5 working days. Packaging of goods is done by us and shipping is processed via DHL. Delivery times are provided as guidelines only, and do not take into account possible delays caused by payment authorization, stock availability, customs clearance processes, faulty delivery information or any other unforeseen. 

When your order leaves our warehouse you will receive a tracking number via e-mail which you can use to track your order. At any time, you can check the status of your package using the link in the shipping notification. Unclaimed packages will be returned to us. For all unclaimed packages you will be debited all fees in connection with the return delivery, including any taxes and duties.

Should your order be delayed, you will receive a notification via e-mail. You may cancel the order and get a full refund if you do not accept the new suggested time of delivery. If the order has already been dispatched, you will have to return the ordered items in order to receive repayment.

All dispatched items are insured by LOTTA LUDWIGSON up to the respective amount of the item’s value during time in transit until it is delivered to you. Should you discover any damage to the package prior to opening it, please take a photo and report this to our customer support: support@lottaludwigson.com as soon as possible. Items that are damaged during transportation need to be sent back and are replaced by LOTTA LUDWIGSON free of charge.

If you have already opened the package when you notice the damage, please read section "DAMAGED PRODUCTS"


RETURNS & EXCHANGES

You are always entitled to return or exchange your items within 14 days from the time of delivery. To return an item, please follow the instructions provided on our Shipping & Returns page.

The costs for the return of the order are to be borne by the customer.


When returning a product, you are obliged to keep the product in the same condition as when delivered. You must not have used the product, however you have the right to investigate the condition the product was in when delivered. All original packaging, price labels etc. shall be returned with the product without having been tampered with. If damage or harm is caused to a product while investigated, the product does not qualify for the return policy.

Please note that the responsibility for the return is yours until it reaches us, so we recommend that the return shipment is insured and traceable. Should you return your order from another country than the one it was shipped to, please contact our customer care at support@lottaludwigson.com

LOTTA LUDWIGSON will repay the price of the item as soon as possible, however at the latest within 30 days from the date the item was returned and received by us. The funds will be returned to your original method of payment and can take 5-10 business days to show up on your account, from the time they have been authorized by us.

If your return is not made within the 14-day window or if the returned items do not reflect the original quality, you are not eligible for a refund.

DAMAGED PRODUCTS

LOTTA LUDWIGSON ensures that all products go through several quality control procedures before being dispatched to our customers. We work hard to avoid damages or defects in our products. Should you receive a faulty item, please send us an email to support@lottaludwigson.com including a photo of the defect within 14 days from the time of delivery.

If the defect can easily be repaired, we will give you the option to bring it to your local tailor. Repair costs are on us. If you would rather exchange your item for a new one, we will replace your item with a new sample of the item in question, if a new one is available. If a new item is not available, you will be refunded with the original cost of the item and the return cost.

We will refund you as soon as possible, however at the latest within 30 days from the date the item was returned and received by us and we have established that the item is damaged or otherwise defective. The funds will be returned to your original method of payment.


RIGHT OF WITHDRAWAL

As a customer within the European Union, you have the right to withdraw from this contract within 14 days without giving any reason.

The cancellation period is 14 days from the day on which you took possession of the goods.

In order to exercise your right of withdrawal, you must inform us via e-mail: support@lottaludwigson.com by means of a clear statement as indicated below of your decision to withdraw from this contract.

EFFECTS OF WITHDRAWAL

If you withdraw from this contract, we shall reimburse you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressively agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.


EXCLUSION/EXTINCTION OF THE RIGHT OF WITHDRAWAL

According to § 312g Abs. 2 BGB a right of withdrawal does not exist for contracts for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or destination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer and it expires prematurely for contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.


COLORS

We cannot guarantee that the colors shown in the webshop reflect the clothes’ colors in reality. The colors can be shown in different ways depending on your computer or phone screen and settings.


INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights, such as trademarks and copyright on our Website and in the material published on it are owned by or licensed to LOTTA LUDWIGSON. You are authorized to use this material only for personal, non-commercial purposes. Any use of the website or its content, including copying or storing such content in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of LOTTA LUDWIGSON. You may not modify the material in anyway, without the prior written permission of the copyright owner. For press inquiries, please e-mail us at hello@lottaludwigson.com.


USER CONTENT

Our website may include user generated content, e.g. from social media applications. LOTTA LUDWIGSON does not claim any ownership in rights in such content (images, photos, videos, etc.) and take no legal responsibility for it. In case you suspect a violation of copyright, or any other right, or otherwise are offended by such content, please contact us at hello@lottaludwigson.com.

OWNERSHIP

Until full payment, the delivered goods remain the property of the seller.


PRE-ORDERS

All pre-orders have to be paid for in full when placing the order. Please bear in mind that the shipping date is only an estimate and may change. In case of a significant production or shipping delay, we will notify you via e-mail. Should you have a change of heart, you are always welcome to cancel your pre-order as long as it is not within 2 days of the stated shipping time and the order has not been shipped yet. After that, our standard return policy applies. 

Orders, which include one or more pre-order items and one or more non-pre-order items, will be split and shipped separately. 


GIVEAWAYS

These conditions of participation apply to all giveaways carried out by LOTTA LUDWIGSON (hereinafter referred to as “organizer”). Each participant accepts these conditions of participation by participating. The organizer's giveaways are not affiliated with Meta. They are in no way sponsored, endorsed or organized by Instagram or Facebook and do not create any legal claims against the company Meta. All information in the context of the competitions is provided exclusively by the organizer.

Any natural person who is at least 18 years old is entitled to participate. The organizer reserves the right to exclude persons from participation who violate these conditions of participation or gain or seek to gain an advantage over other participants by improperly influencing or manipulating the competition. In these cases, the organizer can also subsequently exclude participants from the competition, withdraw prizes and reclaim them.

Participation is only possible within the period specified in the competition description. Each participant may only enter an identical competition once. Employees of the organizer of the competition as well as employees of the companies involved in this competition and their direct relatives are excluded from participating in the competition. Immediately after the participation period has expired, the winner will be randomly drawn from the participants.

A change or cash payment of the price is excluded. The prize is not transferable.

The winner will be notified by e-mail or via Instagram Direct Message by the organizer. Each participant notified in this way is obliged to inform the organizer within one week of the notification being sent whether they will accept the prize. If the organizer does not receive a corresponding message within this period, the possibility of accepting the prize expires and the organizer reserves the right to identify another winner.

The organizer uses the data received from the participants as part of the participation in the competition to carry out and process the competition. You can object to the storage and use of your data for this purpose at any time by sending an e-mail to hello@lottaludwigson.com.

FINAL PROVISIONS

Should any provision of these Terms and Conditions be ineffective, this shall not affect the remaining provisions. In place of the invalid provision, the relevant statutory provisions apply.

German law applies.

The place of fulfillment and jurisdiction is, as far as legally permissible, for deliveries and payments as well as all disputes arising between the parties, Germany. For end-consumers, the place of performance and jurisdiction is the buyer's place of business.
